These Terms & Conditions ("Terms") govern the website design and development services provided by Made by Max ("we", "us", "our", ABN 41 898 891 958) to clients ("you", "your"). By engaging us for a project, booking a consultation, or using madebymax.shop, you agree to these Terms. They are governed by the laws of New South Wales, Australia.
1. Services
Made by Max provides website design and development services for trade businesses across NSW, including the Hunter, Lake Macquarie, Central Coast, and Sydney regions. The specific scope of work, deliverables, and timeline for each project will be agreed with you directly via quote or written proposal before work begins.
Standard website packages include Basic ($499), Professional ($999), and Premium ($1,599). Optional add-ons include AI setup, local SEO, logo design, and Google Ads setup. Ongoing hosting and maintenance is available separately on a month-to-month basis.
2. Quotes and pricing
Quotes are estimates based on the project scope discussed at the time. Final pricing may vary if the agreed scope changes. Any changes to scope will be discussed and agreed with you before additional charges apply.
For standard website packages, a 50% deposit is required to begin work, with the remaining 50% due on completion before the site goes live. Add-ons and ongoing plans are invoiced as agreed in your proposal.
3. Payment terms
Invoices are payable by bank transfer or the payment method specified on the invoice. Website project deposits are due before work begins; final balances are due before launch. Ongoing maintenance and growth plans are billed monthly in advance.
If payment is not received by the due date, work may be paused and the site launch delayed until the outstanding amount is settled. Late payments may incur a pause in ongoing services until brought up to date.
4. Project timelines
Standard websites are typically delivered within 15 days from receipt of the required content (logo, text, images, and a brief). Timelines depend on how quickly you provide content, feedback, and approvals. Delays on your end may extend the delivery date accordingly.
5. Revisions and approval
Each project includes two rounds of revisions as part of the agreed scope. Additional revisions or out-of-scope changes may be charged at an hourly rate or quoted separately. The site will be launched once final approval is received in writing or via email.
6. Intellectual property and ownership
Once a project is paid in full, ownership of the final website design and content created specifically for you transfers to you. We retain the right to showcase completed work in our portfolio and marketing materials unless you request otherwise in writing.
Any third-party assets used in your website (such as stock photos, plugins, fonts, or licensed themes) remain subject to their own licence terms and may not be fully transferable.
In practice, your site is hosted and maintained through Made by Max Web Design. If you choose to leave, we will provide a complete export of your website files and content within 14 days of your request, at no charge. Your domain is registered in your name and remains yours. There is no lock-in contract and no exit fee.
7. Hosting and maintenance
Website hosting and maintenance is not included in the upfront website package price. It is offered separately through the Monthly Maintenance plan ($149/mo) or Growth Plan ($299/mo), both on a month-to-month basis with no lock-in contract.
If you cancel ongoing hosting, your site will be taken offline at the end of the current billing period. On request, we will provide a complete export of your website files and content within 14 days so you can move it to another host. You remain responsible for any domain registration or third-party service fees.
8. Cancellations and refunds
Deposits are non-refundable once work has commenced, as they cover the time and resources allocated to your project. If you cancel before work begins, the deposit will be refunded in full.
If a project is cancelled partway through, you will be invoiced for work completed up to that point. Ongoing plans can be cancelled at any time and will stop at the end of the current billing period.
9. Client responsibilities
You agree to provide accurate information, timely feedback, and any content (text, images, logos) needed to complete the project. Delays in providing these may affect project timelines.
10. Limitation of liability
To the extent permitted by law, Made by Max is not liable for indirect, incidental, or consequential losses arising from your use of the website we build, including loss of revenue, data, or business opportunities. Nothing in these Terms excludes any consumer guarantee or right under the Australian Consumer Law that cannot lawfully be excluded.
11. Third-party services
Our services may involve or link to third-party platforms (such as Meta, Calendly, hosting providers, or website builders). We are not responsible for the availability, performance, or policies of these third-party services.
12. Confidentiality
Any confidential business information you share with us during a project will be used only for the purpose of delivering that project and will not be disclosed to third parties without your consent, except as required by law.
13. Changes to these Terms
We may update these Terms from time to time. The "Last updated" date at the top of this page will reflect the most recent version. Continued use of our services after changes are posted constitutes acceptance of the updated Terms.
14. Governing law
These Terms are governed by the laws of New South Wales, Australia, and any disputes will be subject to the jurisdiction of its courts.
